The digital revolution has transformed how we shop, bank, learn, and connect – but it has also opened new doors for criminals. Cybercrime is no longer a niche concern of tech companies; it now touches everyone from a retired pensioner receiving a suspicious WhatsApp link to a multinational corporation defending its data servers. To tackle this growing threat, it helps to first understand how cybercrimes are classified and what makes each category unique.

What is cybercrime?

In simple terms, cybercrime refers to any illegal activity where a computer, mobile device, or network is used either as a tool, a target, or both. According to the Ministry of Home Affairs, cybercrime is any unlawful act where a computer or communication device or computer network is used to commit or facilitate the commission of a crime. These offences range from stealing someone’s OTP to orchestrating attacks that cripple national infrastructure.

The scale of the problem is staggering. According to the National Crime Records Bureau, the total number of cybercrime cases recorded in India rose from over 52,000 in 2021 to more than 86,000 in 2023 – a sharp climb that reflects both rising digital adoption and the ingenuity of cybercriminals.

The four broad categories of cybercrime

Legal scholars and cybersecurity experts generally group cybercrimes into four categories based on who or what is being targeted. This classification is not just academic – it directly shapes how law enforcement agencies investigate cases and how courts apply the Information Technology Act, 2000. The four categories are:

Cybercrimes against individuals – attacks aimed at a specific person’s identity, privacy, or finances.
Cybercrimes against property – offences that target digital assets, intellectual property, or data owned by someone.
Cybercrimes against organizations – coordinated attacks on companies, institutions, or government departments.
Cybercrimes against society – large-scale offences that threaten public order, morality, or national security.

Let’s unpack each category and look at the specific offences that fall within them.

Cybercrimes against individuals

Ordinary citizens are the most frequent victims of cybercriminals, often because of limited digital literacy and weak personal cybersecurity. According to a report cited by iPleaders, about 44% of individuals consider themselves as ‘worthwhile targets’ for hackers. Here are the most common forms.

Email spoofing and phishing

Email spoofing happens when a criminal forges the sender’s address to make an email look like it came from your bank, a government office, or a trusted friend. Phishing takes this further by using these deceptive messages to trick you into sharing passwords, OTPs, or card details. The consequences can range from drained bank accounts to full-blown identity theft.

Cyberstalking and cyberbullying

Cyberstalking uses electronic communication to harass, threaten, or intimidate. The IT Act, 2008 addresses this under Section 72, with Section 67 providing imprisonment up to three years along with a fine. Cyberbullying – though not formally defined in Indian law – includes online humiliation, threats, and the sharing of embarrassing content. The problem is especially acute among young people.

Identity theft and online harassment

Identity theft involves stealing someone’s personal information to impersonate them, usually for financial gain. Online harassment can include morphed images, defamation, revenge porn, and coordinated trolling. Victims – particularly women – often face social stigma that discourages them from reporting these crimes.

Cybercrimes against property

Just as thieves steal physical goods, cybercriminals target digital property. This category is closely tied to intellectual property rights and is governed by a combination of the IT Act and the Copyright Act.

Software piracy

Software piracy is perhaps the most familiar property-related cybercrime. It covers the unauthorized copying, distribution, or use of proprietary software. Under the Indian Copyright Act, software piracy can be prosecuted under both civil and criminal law, with imprisonment ranging from seven days to three years and fines between โ‚น50,000 and โ‚น2,00,000.

Piracy takes several forms – end-user piracy (installing on more machines than the licence allows), hard-disk loading (dealers pre-installing illegal copies), counterfeiting (producing fake discs), and internet piracy (uploading unauthorized copies online).

Intellectual property infringement

Beyond software, criminals routinely infringe on copyrights, trademarks, patents, and designs in the digital space. Common examples include reproducing copyrighted music or videos, using another company’s trademark without permission, and cybersquatting – registering domain names that closely resemble established brands. A landmark Indian case, Yahoo!, Inc. v. Akash Arora (1999), dealt with a defendant using the domain name ‘yahooindia.com’ and resulted in a permanent injunction.

Cyber vandalism and data destruction

Sometimes the goal is simply damage. Cyber vandalism involves defacing websites, corrupting databases, or destroying digital files. Virus and worm attacks fall here too – malicious programs that spread through networks, corrupting or deleting data along the way.

Cybercrimes against organizations

When criminals set their sights on businesses, hospitals, banks, or government departments, the scale of harm multiplies. A single breach can compromise millions of records and cause losses running into crores of rupees.

Data theft and unauthorized access

Data theft is one of the most lucrative crimes in the digital age. Attackers break into corporate systems to steal customer records, trade secrets, financial data, or medical histories. The IT Act, 2000 criminalises activities like hacking, data theft, and unauthorised access, while laws under the Bharatiya Nyaya Sanhita handle offences like forgery, fraud, and extortion.

Denial-of-service attacks

In a DoS or DDoS attack, criminals flood a server with so much traffic that legitimate users cannot access it. Banks, e-commerce sites, and government portals are common targets. The disruption can halt operations for hours or even days, causing both financial loss and reputational damage.

Ransomware and cryptojacking

Ransomware encrypts an organization’s files and demands payment – often in cryptocurrency – for the decryption key. Cryptojacking is subtler: criminals secretly use the victim’s computing power to mine cryptocurrency. In one notable incident, over 2,000 computers at Aditya Birla Group were attacked by hackers for mining cryptos.

Insider threats and corporate espionage

Not every attack comes from outside. Disgruntled employees, contractors, or ex-staff with privileged access can leak sensitive information to competitors or criminals. Insider threats are especially hard to detect because the perpetrator often has legitimate credentials.

Cybercrimes against society

The fourth category covers offences whose victims are not one person or one company but the broader community. These are often the most dangerous in terms of long-term social impact.

Cyber terrorism

Cyber terrorism, sometimes called digital terrorism, is committed with the intent to threaten the sovereignty or integrity of the country or cause fear by disrupting information systems, data, or programs. Attacks on power grids, defence networks, or banking infrastructure fall here. The stakes are national – and sometimes international.

Online forgery and counterfeiting

Digital tools have made forgery easier than ever. Criminals create counterfeit certificates, fake currency, forged government IDs, and fraudulent financial documents. These feed into larger scams – fake job offers, bogus educational degrees, and sham investment schemes – that harm both individuals and institutions.

Online child exploitation

Perhaps the most disturbing category involves the creation and distribution of child sexually abusive material (CSAM). The IT Act, under Section 67(B), makes it punishable to publish or transmit material depicting children in sexually explicit acts. Dedicated reporting mechanisms now exist to allow anonymous complaints on the National Cyber Crime Reporting Portal.

Misinformation, cyber warfare, and online radicalization

Finally, the spread of fake news, politically motivated hacking, and online recruitment by extremist groups also falls under crimes against society. These offences erode democratic discourse, inflame communal tensions, and in extreme cases incite real-world violence.

Why this classification matters

Classifying cybercrimes is more than an academic exercise. Each category demands a different response. Crimes against individuals call for digital literacy campaigns and accessible grievance mechanisms. Crimes against property need stronger IP enforcement. Attacks on organizations require robust cybersecurity infrastructure. And crimes against society demand coordinated action across agencies, often across borders.

The government has responded with several institutions. The Ministry of Home Affairs set up the Indian Cyber Crime Coordination Centre (I4C) to deal with all types of cyber crime in the country, in a coordinated and comprehensive manner. The National Cyber Crime Reporting Portal and the toll-free helpline 1930 allow citizens to file complaints quickly, and a Citizen Financial Cyber Fraud Reporting and Management System works in real time to freeze fraudulent transactions.

The challenges of enforcement

Despite these efforts, enforcement remains difficult. Cybercriminals enjoy anonymity, global reach, and sophistication – using advanced malware, phishing tactics, and high-level hacking skills. Jurisdictional boundaries complicate investigations when attackers operate from foreign servers. Add to that the shortage of trained investigators and digital forensics infrastructure, and it becomes clear why conviction rates lag behind the pace of new attacks.

For citizens, the best defence remains awareness. Recognizing the warning signs of phishing emails, using strong passwords, enabling two-factor authentication, keeping software updated, and reporting suspicious activity quickly can prevent many cybercrimes before they cause serious damage.
